Acceptance of these terms

By creating an account, buying credits, using an API key, uploading a file, submitting data for validation, or otherwise using the service, you agree to these terms.

If you use the service on behalf of a business or other organisation, you confirm that you have authority to bind that organisation.

The service

Data Checks provides data cleaning and validation services, including phone number validation, email validation, API access, bulk CSV validation, usage reporting, and related tools.

Validation results are based on third-party data sources, technical checks, network signals, formatting rules, and other information available at the time of processing. Results are indicators, not guarantees.

Your responsibilities

You are responsible for the accuracy, quality, legality, and lawful collection of all data you submit to the service.

You must ensure you have all permissions, notices, consents, contracts, and lawful bases needed to upload, validate, store, use, or act on the data and results.

You must not use the service for unlawful, harmful, discriminatory, fraudulent, spam-related, or abusive purposes, or to breach data protection, privacy, electronic marketing, telecommunications, sanctions, or consumer protection laws.

You are responsible for keeping account credentials and server-side API keys secure and for all activity under your account unless caused by our breach of these terms.

Client-side API keys are designed for browser use: they are not secret, are bound to hostnames you configure, and are subject to per-day and per-minute limits. Anyone who can load your site may be able to reuse the key within those limits; you remain responsible for how you deploy it, for monitoring usage and credits, and for abuse that arises from your pages or domains.

No guarantee of accuracy or outcome

We use reasonable care and skill in providing the service, but we do not warrant that validation results will be complete, error-free, uninterrupted, current, or suitable for any particular purpose.

A valid, invalid, risky, unknown, or similar result should not be treated as a guarantee that a person can be contacted, that a contact method exists, that a message will be delivered, that a number or address belongs to a particular person, or that contacting them is lawful.

You must make your own decisions about how to use validation results and should not rely on the service as the sole basis for legal, compliance, marketing, credit, employment, eligibility, or other significant decisions.

Credits, payments, and billing

The service may operate using prepaid credits. Credits are consumed when validation requests, bulk jobs, or other chargeable actions are processed, whether the result is valid, invalid, unknown, or otherwise.

Credits do not expire while your account remains active, unless otherwise required by law or agreed in writing.

Prices, credit volumes, and included features are shown on the website or in the application and may change from time to time. Changes will not usually affect credits already purchased unless required by law or clearly stated.

Payments are processed by our payment provider. You must provide accurate billing information and comply with the payment provider's terms where applicable.

Except where required by law or expressly agreed in writing, purchased credits are non-refundable and have no cash value.

Availability and changes

We aim to provide a reliable service, but we do not guarantee uninterrupted availability. Maintenance, updates, supplier outages, security incidents, traffic spikes, or events outside our control may affect access or performance.

We may update, suspend, withdraw, rate-limit, or change parts of the service where reasonably necessary for security, compliance, operational, commercial, or product reasons. That includes per-minute throttling, per-day caps on client-side API traffic, and changes to how browser origins are validated.

Data protection

Each party must comply with applicable UK data protection law. Our Privacy and Cookie Policy explains how we process personal data in connection with the service.

Where we process personal data on your behalf as a processor, we will process it only to provide, secure, support, and improve the service, or as otherwise instructed or required by law. You remain responsible for your controller obligations.

Intellectual property

We and our licensors own the service, software, website, documentation, branding, and related intellectual property. You receive a limited, revocable, non-exclusive, non-transferable right to use the service in accordance with these terms.

You retain ownership of data you submit. You grant us the rights needed to host, process, transmit, analyse, validate, and return that data for the purpose of providing and securing the service.

Confidentiality

Each party must keep the other party's confidential information confidential and use it only for purposes connected with these terms, except where disclosure is required by law or the information is already public through no fault of the receiving party.

Suspension and termination

We may suspend or terminate access if you breach these terms, fail to pay, create security or legal risk, misuse the service, or if continued provision would expose us or others to liability or operational harm.

You may stop using the service at any time. Termination does not affect accrued rights, payment obligations, consumed credits, or terms that are intended to continue after termination.

Liability

Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any statutory rights that cannot be excluded.

Subject to the previous sentence, we are not responsible for loss of profits, sales, business, revenue, goodwill, reputation, anticipated savings, data, contracts, opportunities, or for indirect or consequential loss.

Subject to the first sentence of this section, we are not responsible for losses arising from your data, your instructions, your use of validation results, unlawful or non-compliant marketing, third-party services, downtime, inaccurate source data, deliverability decisions, blocked messages, or business decisions made using the service.

Subject to the first sentence of this section, our total aggregate liability arising out of or in connection with the service and these terms is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim.

Indemnity

You agree to indemnify us against claims, losses, damages, fines, penalties, costs, and expenses arising from your breach of these terms, your submitted data, your unlawful use of the service, your breach of data protection or marketing laws, or your use of validation results.

Governing law and courts

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over disputes arising from or connected with these terms or the service.

Changes to these terms

We may update these terms from time to time. The version published on this page is the current version and applies from the date it is posted. Continued use of the service after changes are published means you accept the updated terms.
